1. Introduction
Welcome to JobGenics. These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and any other products and services (collectively, the “Site”) provided by JobGenics. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
2. Definitions
- “Job Seekers”: Individuals using the Site to search for employment opportunities.
- “Employers”: Individuals or organizations seeking to post job listings or hire candidates.
- “User Content”: Any information, data, text, or other materials submitted by a user through the Site.
- “Services”: Any free or paid services offered by JobGenics, including job postings, resume submissions, and premium recruitment features.
3. Eligibility
You must be at least 18 years old and reside or operate in Pakistan or Dubai to use our Site. By using the Site, you represent and warrant that you meet these eligibility requirements and will comply with all applicable employment and labour laws in your jurisdiction.
4. Job Seeker Terms
As a Job Seeker:
- You may use the Site to search and apply for job listings free of charge.
- You are solely responsible for ensuring your resume, profile, and application materials are accurate, complete, and up to date.
- JobGenics does not guarantee interviews, job offers, or employment as a result of using the Site.
- You must not provide misleading, false, or fraudulent information.
5. Employer Terms
As an Employer:
- You may create an account and post job opportunities on the Site free of charge, unless you choose to purchase optional premium services (such as featured listings or advanced recruitment tools).
- You are responsible for the accuracy, legality, and truthfulness of all job postings.
- All job postings must comply with applicable laws, including Pakistan’s labour laws and UAE Federal Decree Law No. 33 of 2021.
- Job postings must not be discriminatory, misleading, or involve recruitment scams, pyramid schemes, or requests for payment from Job Seekers.
- You must ensure fair and transparent hiring practices.
- JobGenics reserves the right to remove or suspend any job posting that violates these Terms.
- Employers using paid services must comply with our payment policies and provide valid billing information.
6. Free & Paid Services
- The use of JobGenics is free for both Job Seekers and Employers.
- Optional premium services are available to Employers for enhanced visibility, featured job postings, or advanced recruitment support.
- Paid services are billed in Pakistani Rupees (PKR) for Pakistan-based users and UAE Dirhams (AED) for Dubai-based users.
- Applicable taxes, such as Sales Tax (Pakistan) or VAT (UAE), will apply to premium services.
- Payments are non-refundable unless stated otherwise in our Refund Policy.
- JobGenics reserves the right to suspend premium services for unpaid invoices.
7. Data Privacy
Your use of the Site is also governed by our [Privacy Policy] and [Cookie Policy].
- Data collection, storage, and processing will comply with the Prevention of Electronic Crimes Act (PECA) in Pakistan and the Personal Data Protection Law (PDPL) in the UAE.
- Users have rights to access, correct, or request deletion of their personal information.
8. Prohibited Conduct
You agree not to:
- Use the Site for unlawful purposes, including fraud, harassment, or abuse.
- Post misleading job opportunities or request payment from Job Seekers.
- Scrape, copy, or use Site data without authorization.
- Attempt to interfere with or disrupt the security of the Site.
9. Intellectual Property
- All content on the Site, including text, graphics, software, trademarks, and logos, is owned by JobGenics or its licensors.
- Users are granted a limited, non-exclusive, non-transferable license to use the Site for personal, non-commercial purposes.
- You may not copy, modify, distribute, or create derivative works without prior written consent.
10. Third-Party Services
The Site may include links to third-party websites, job boards, or advertising networks. JobGenics does not control or endorse these third-party services and is not responsible for their content, policies, or practices.
11. Termination & Suspension
JobGenics reserves the right to:
- Suspend or terminate your account at any time if you violate these Terms or applicable laws.
- Remove or block any content that breaches our policies.
- Restrict access to the Site temporarily or permanently for operational, legal, or security reasons.
12. Indemnification
You agree to indemnify and hold harmless JobGenics, its affiliates, directors, and employees from any claims, damages, liabilities, or expenses arising out of your use of the Site, your violation of these Terms, or your infringement of any rights of third parties.
13. Disclaimers & Limitation of Liability
- The Site is provided on an “as-is” and “as available” basis.
- JobGenics makes no guarantees regarding job placement, hiring outcomes, or uninterrupted availability of services.
- To the maximum extent permitted by law, JobGenics shall not be liable for any indirect, incidental, punitive, or consequential damages, including lost opportunities, even if advised of the possibility of such damages.
14. Governing Law & Dispute Resolution
- For users in Pakistan, these Terms are governed by the laws of Pakistan, with exclusive jurisdiction in the courts of Karachi.
- For users in Dubai, these Terms are governed by the laws of the United Arab Emirates, with exclusive jurisdiction in the courts of Dubai.
15. Changes to Terms
JobGenics may update these Terms from time to time to reflect changes in our services, business, or legal requirements. Any updates will be posted on the Site, and the “Last Updated” date will indicate when they take effect. Continued use of the Site after changes constitutes acceptance of the updated Terms.
